This section provides a basic overview of what to do when involved in a personal injury matter while in California.

What should you do if involved in an automobile accident?

NOTE: If you have already been involved in an accident, it may be too late for this section.

If you are involved in an automobile accident, you should:

  1. Get the name and driver's license number of the other driver.


  2. Verify that the other driver has proof of insurance.


  3. Get the name, address, and phone number of any witnesses.


  4. Observe your surroundings. Write down the time, the condition of the road(s), and the weather conditions.


  5. If you keep a camera in your car, and it is safe to do so, take pictures of the vehicles before they are moved. At the least, try to take pictures of the license plate and full views of the other vehicle.


  6. Notify your insurance carrier, even if you do not believe you were at fault.


  7. When possible make notes of whatever you remember.

Do the police need to be called?

  • Depending on the jurisdiction, a police officer will not come to the scene unless there is an injury involved, or one of the vehicles is disabled.

What if you are injured?

  • See a doctor as soon as possible. Tell the doctor all the parts of your body that are hurt. Make sure the doctor correctly documents your injuries.

What if you do not have insurance?

  • Under California law, if you are driving without insurance, your damages are limited to your actual damages. You cannot obtain a recovery for your pain and suffering.
